Here’s a statement from the UK Government’s Financial Ombudsman’s office with responsibility for Insurance Services specifically on this matter:

Im sorry for those of you living in the UK and having this kind of exclusion clause in your policy.

That said, I would defer back to my original statement. This isn't discretionary; it will be noted within your policy, as the note from the Ombudsman indicates:

'We’re encouraging drivers to check their insurance policy small print...'

So my original statement really stands. It's not real if the documentation/policy doesn't support it.
