Damn near impossible to get deported out of this country for anything these days. Even if you commit a crime. However, you could call the FBI anonymous terrorist tip line and send him/her to Gitmo for awhile. That's a joke by the way. Don't seriously do that because that would be really messed up.

Here is the thing. He has already passed the 45 day wait period. He is from Germany but was working in Argentina under someone else's sponsership. I got it transferred to me. I was warned about his intentions from his first sponser but I didn't listen. He ended up working for me for about 6 months up until i found out he was stealing from me and my clients. I now have soo many issues that he is not even willing to help me work out. I wanted him in the country at first so i can effectively point my finger at him but I already settled and paid things off. Now I go to find out this prick is trying to get a part time job working for another investment company and saying he currently works with me. Thats some nerve if you ask me. He has no family here. I want him out. His Visa is revoked. He is not in transfer status. He is illegal...

If you have proof that he steal something from you, then call the police and open a report, he will be arrested and then transfer to the INS for deportation.

Any time you get the government involved, it will take a good while (I had obtained work visa multiple times from the INS).
You may be better off spending your time on your side business.

Not to be a picker of nits but there is no such thing as the INS as mentioned many times in this thread. The old INS is now under The Department of Homeland Security and is called the United States Citizenship and Immigration Services (UCSIS).

the government is not going to send someone out to track down someone you want to get out of the country. Sorry, not going to happen. If that were the case thousands would be getting tracked down then held then deported. It takes a long time and ($).
Report that this person is no longer an employee and let the government stop his immigration/visa., thats about the best you can do. it takes months to years to deport convicted criminals, the government will not actively seek and deport someone who has overstayed a visa.

Trust me when he shows up at your door before his deportation hearing with a gun - he'll have a reason as well. Don;t destroy someones life because they are being a dick. I'm sure he is not the first person in the world who has used false references. Seriously, ask yourself what you would do had the guy been a citizen.
