I think it's better to ask them.
But if you tell them you dont want the compensation, they probably won't offer you the job.

We've enforced them against a few employees before, even in TX, where it's supposed to be much more difficult. Check with an employment lawyer to be sure.

Confirmed - it is at will employment, and I have the right to back out.
