any landlords here?
like the title says, is there any landlords here? I have a problem with a tenant that leased my house, horrible experience, total liar and I'm in the process of evicting her. is there anything else I can do to blast her name/company so other landlords don't get burned by her?

Sounds more like you want some payback because of this negative experience. Just evict her and be done with it.
You don't want that somehow flipping on you and making her out to be the victim. |

This. You have to be VERY careful as "defamation of character" is really big these days. A Lawyer friend of mine is making hand over fist for clients suing for this very reason.
I know it sucks. But your best bet is to hurry and get her sorry ass up out of their, go in and fix the place back up and get it rented out again. Of course is they knocked holes in walls or burned up carpet or some shit, then you can take her to small claims. Even if she's broke, a judgement against her will stick for up to 20yrs. So if and when they become solvent, you can collect with interest. Of course if she files BK then you're SOL.

Yes I'm a landlord. I had an experience like yours. Best thing is to hurry the process up as much as you can and get her out. One lesson I learned it to try and choose people with good credit. They pay no problem and take care of your home.

i'm not going to berate you or anything, but i'm curious as to how much due diligence you did in your checks to ensure she would be a good tenant.
references? credit? work? with the benefit of hind sight, were there any tip-offs or hints of this? i'm only asking because i'm a landlord myself and i have only had one long-term tenant. i'm going to be picking up more properties, and every little tip from experience helps.

wow, alot of responses here, first I want to say that I am using a property manager so eviction is in place and will find out tomorrow what the ruling was. my property manager checks credit/past history of renting etc.... she basically lied on her application across the board as far as her business etc....basically she was using my house for her own deed, renting bung beds etc even though the contract said only her and other person will occupy the house. I'm ok with her getting out of there as long as the house is in good shape. if not do I take her to small claims court?
I gotta admit that the property manager is doing doing a great job as I had to do some investigate work to find all this out myself.. |

Property management is a necessary evil, at best. Our family trust does all the work except for 2 out of state properties. Guess which ones we have all the trouble with? They were growing weed in the basement and our manager didn't know. . . Not only do we do all the maintenance, we also do regular inspections to make sure things don't get out of control. Even with a lawyer in the family, we still have some issues with getting people out, and I'm made more than a few appearances in small claims court to testify to the condition of a property before and after a tenant was there.
The PM does not care if your property gets trashed, only that it is rented and they get their fee. The ONLY thing you can legally do, IF you ever get a reference request, is to be honest in the things you can prove were occurring that lead to the eviction for breach of contract, and include a copy of the publicly available eviction judgment.. |

we use a PM for our rentals and she does in fact care about condition for both sides and is quite the bitch when applying; pulls credit , rental history(evictions) and references etc.. Never had an issue in the 10 years we've used her. Had to evict one person once before using a PM and short answer to the original question is no. I'd personally refer any requests to the publicly available eviction notice and not say a word .
My sister has a rental is a shady part of OC and has had a tenant come back on her after eviction and sue for defamation which went nowhere but did cost time to fight it.(Can't get your own personal time which you cannot quantify back in any judgment). |
