You have the right to sue anyone for any reason. Now whether something is worth your time and money is another thing, let alone wondering whether the charges will hold up in court.

His odds of the claim holding up in court are good I think, but getting a qualified attorney to tell it will or want is going to cost $500 before any legal notices is filed.

You can count of several thousand dollars in legal fees if pursued as far as practical. Since the defendant doesn't seem to have a pot to p*ss in the attorney should advise to back off, BUT if Twitchy comes in with the smell of money on him, the attorney will do whatever is his heart's desire.
