Miranda is only required for interrogation in custody. You can arrest someone without ever giving a Miranda warning. In most cases, however, the Miranda warning is given at some point. As it pertains to DUI's, Miranda is given at the very end of the field investigation before being taken into custody (..e.g..post initial questioning [not about the crime itself], field sobriety tests, PAS, etc.).

So here's the update (…or as much of it as I can state publicly):

There is chatter that the suspect is possibly an academy wash-out, but I cannot confirm that at this time. The suspect is a 22 year old male who resides in L.A. County. CHP is taking the lead on the investigation.

As for the injuries, there are some amputations and two are in critical condition (…with one of them bordering on death). Some of the major injuries include lips being ripped off of faces, trauma to the head with the skull visible, etc. This is tragic.

When Villanueva made a report last night about 5:30, and he mentioned "amputations," a very firm "<expletive>" from me, and the wife echoed with "Oh, no!"


It would be great for someone to come on and say "Just kidding, we were testing the recruits under EXTREME stress conditions" Unfortunately, I'm not holding my breath.
