Do not do this. Once you threaten the legal recourse move, that's all you can do. If you called me and said that, I wouldn't say a word and only wait for your certified letter that you're suing me. Its called bluffing, if done properly it works, plus he already contacted an attorney. Telling Ian that an attorney will contact him, gives Ian a choice ahead of time; settle now or go to court and lose even more money. Plus there was a 24 hour window to make a deposit.

It keeps a record on both ends. You call enough times, there will be phone record on both ends that will show that OP has done everything on his end to contact a manager and make a deposit. Once again, there was a 24 hour window to make a deposit. Plus, if you call enough times, Ian will have zero Deniability that OP hasnt tried to contact some one to make a payment.

Doing nothing and siting on your hands will get you nothing. You want results you have to take action, even if it means crazy and drastic action.

You're complicating things too much. I understand you won at $55k but if the dealer doesn't cooperate then leave or negotiate down to $56k or $57k. This is a Honda dealership so $100 is a lot to them let alone $1k or $2k. If they're selling at $59k you would always negotiate the price down as they probably bought it for $54/55k.

I just saw the same car on cars.com for $62,674. So I guess $59k is reasonable.

They didn't cancel the auction, it ended with a highest bidder. However they did state you had to make payment within 24 hours, if you didn't pay yet then they have their way out.

if you read i called to make the deposit but it was refused by Ian the used car manager. He refused to accept my deposit and refused to put it in writing
