Is this legal?

Okay. So I'm suppose to be moving next week (June 1) and my roomie and I had a place that we found about two weeks ago and we had a verbal agreement (through email) with the owner/relator that the place was ours and we were just waiting for the lease paperwork. Well she kept making excuses and not calling back and she just emailed me today telling me that she's sorry things didn't work out and the place is no longer available... I mean there was no lease signed but she kept stringing us along and told us it was ours after we put in the application and now have no place to live and need to find a place in 8 days... I mean is that legal?!?! I know it's definately unethical...

What were the terms of the emails? These days emails are just as good as written contracts. If there was an offer communicated, and it was accepted, then a binding contract has been made.

I submitted the application for the rental which included all my personal information, the lease terms (12 months, rent, move-in date) and she sent me an email telling me the place was mine we just needed to sign the paperwork... (that email was about two weeks ago.)

I'm pretty sure that's not legal. But to be sure.

Ask another person to call and see if the place has been rented.

If not, you have a good case.

This happened to a friend of mine. He had an appointment to see the owners of an appartment for rent. Once the owners found out he as African, he was told the place was rented.

I called to see if the place was avaiable for rent, and sure enough it was.

My friend won $10K from the case.

Good luck and hope you find a place soon.

Well I talked with the tenants who currently live there (moving out this week) and they told me no one has seen the place but me.

So I think it is waaaay fishy.

Can you copy and paste the context of the reply email indicating it's your place? It all depends on wording.

Having someone else call to see if it's available is not a bad idea. But why would she not want to rent to you?

While I agree that it seems fishy and you may have legal recourse against the owner, Do you really want to live somewhere like that? Even if it's just some shady dealings and it's not actually against you personally. I definitely find that having a good relationship with the management of the place I rent makes a big difference. I almost always get repairs done same day and stuff like that.

Yeah, I mean it's one of those things where I just feel screwed over. I definatley don't want the place esp. after learning what kind of people they are but it's put me in a bad position and very very angry.

That's why you have the Law on your side. My friend never moved into the location.

He sued for housing discrimination which is against the law, and this applies to all states. Good luck.

if you can prove that there is vaild verbal agreement, in california, that is illegal to rent it to someone else. there is same case shows on Business Law 1A reference book. Not sure the law in your state, tho. go to law college to check it out.

I wouldnt even try to push it with them. As you have said, it tells you about who they are as a landlord if thats what they are trying to pull on you now... If there was any deposit, I would certainly ask for it back in full...

I called the owner/relator's assistant.

They decided to rent it a fellow Korean she told me.

Whatever, I am so mad about this. Screw moving out I'm going to mod my car instead... at least Hans will always love me and never let me down...

Unless you have a lease contract you have no legal hold on the unit.

There's alot of units there, don't waste you time on this, pickup the pcs and get your deposit and move on.
