The 350Z was hit today :( Insurance Help)

So, apparently someone decided it was a great idea to hit the back of my wifes 350z today while taking a right turn in a medical center(ironic).

So our custom satin black; The whole back bumper is done and possible quater panel damage. It could be an optical illusion on the quater panels because a bumper has not enough strengh to bend the tips of the quanter panels, so its probably the bumper bent down odd-like to make the quanter panels look bent.

Thats it, just bumper bent to no return.

Insurance place was close at the time, but the cop said we can pick up the report tomorrow. The women confessed to not paying attention. She got a ticket stating to much speed but speed not determine.

Insurance Help: Since the vehicle has no lean and I outright own it... I am lead to believe that I get the cut(check) from the damage and it doesnt go to a body shop and get the work done and they get all the money. Correct me if I am wrong on how this works.

This happened in Texas(for law purposes).

I don't think theres a hard and fast rule about whether there is a check cut or not. I got a check cut after hail damage and I have a loan out on the car. OTOH, I drove my first car into a tree. I outright owned it and they paid the body shop directly.

You need to speak to your insurance directly if you want correct answer.

similar thing happened to me.

Someone backed into my car.

I did not go through my insurance comapny at all. She admitted fault (luckly i had witness statements) She had AAA insurnace

The steps i went through

I had my car inspected by my body shop.
Insurance sends out an appraiser. he takes pictures and makes a report

A week later, I get a choice of fixing it vs getting a check.
They low ball me on the check with their own estimate.
I fax them my estimate. A few weeks go by and they give me a new counter offer.

I accept their lower offer due to time being wasted with it.

Rear bumber, rear quater panne and tail light damage.
My estimate through BMW certified shop/dealer shop was 1400
Their inital offer 775. I accepd 1000.

I think if i had it fixed, they would have paid the full amount due by hte body shop.

Did you settle for a check or just let the body shop handle it?

Sometimes if you settle for a check you might be able to pocket some amount. But if the bodyshop handles it you usually get 0.

1700? Sounds a little cheap (actually, a lotta cheap) for an entire paint job. Hope the shop's reputable.
